Judge Retires But Probe Continues Over Racist E-Mail About Obama

Montana U.S. Chief Judge Richard F. Cebull, who forwarded a racist e-mail message about President Barack Obama, will retire from active service, following an online petition drive that called for his resignation.

Cebull, who has been chief judge since 2008, will take “senior status” beginning March 2013, according to Travis McAdam, executive director of the Montana Human Rights Network, which launched the petition drive. “This means he will be retired from active service, however, he will still hear some cases and get his paycheck.”

Karen Redmond, a spokesperson for the Ninth Circuit Court of Appeals, which is investigating Cebull’s behavior, confirmed he will be taking senior status.

Last April, the Ninth Circuit appointed a panel to investigate Cebull after he admitted that he forwarded an email, suggesting that President Obama’s mother conceived him after having sex with a dog. http://www.thenorthstarnews.com/Story/Petition-Asks-Federal-Judge-Who-Forwarded-Anti-Obama-E-mail-to-Step-Down
Cebull, who was appointed to the bench by President George W. Bush, admitted the e-mail was racist, but he claimed he was not a racist.

McAdam, however, is not happy with the Cebull’s decision.

“We still believe that Judge Cebull has violated both the Code of Conduct for judges and the public trust,”McAdam said. “For the sake of judicial integrity, we are still calling on him to resign or fully retire. We anxiously await the findings of the committee investigating the complaints against him.”
